Terms & Conditions
(For Users of hmRide Platform)
These Terms & Conditions (“Terms”) govern your access to and use of the hmRide mobile application, website, and all related services (collectively referred to as the “Platform”), owned and operated by M/s Humride Mobility Private Limited, having its registered office at 703, 7th Floor, Palm Court, M G Road, Sector-16, Industrial Estate, Gurgaon – 122007, Haryana (hereinafter referred to as “hmRide”, “Company”, “we”, or “us”).
By accessing, browsing, registering on, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with any applicable policies incorporated herein by reference.
NATURE OF PLATFORM
hmRide operates as a technology-based intermediary platform that facilitates ride-sharing and mobility connections between independent third-party car owners and passengers. The Platform functions solely as an enabling interface for users to discover, connect, and transact with one another.
hmRide does not own, lease, manage, or operate any vehicles, nor does it employ car owners or act as a transportation service provider. The Company does not exercise control or supervision over the conduct of car owners or the execution of rides.
All transportation services are rendered directly by independent car owners, who are solely responsible for the operation of their vehicles and the provision of ride services. Accordingly, hmRide’s role is limited to providing technological support, including user onboarding, ride matching, and payment facilitation.
While hmRide conducts identity and document verification of car owners as part of its onboarding process, users are advised to note the following:
- Such verification is based solely on the documents and information submitted by the car owner and does not constitute a guarantee, endorsement, or warranty of the car owner’s character, past conduct, fitness to drive, or professional competence.
- hmRide does not conduct criminal background checks beyond what is required under applicable law, and does not independently verify the accuracy or authenticity of any information provided by car owners beyond the verification procedures described herein.
- The Platform relies on third-party verification systems and government databases for identity checks. hmRide is not responsible for errors, delays, or inaccuracies in such external systems.
- Users acknowledge these limitations and agree to exercise independent judgment and reasonable caution when using the Platform. If a user has concerns about a car owner’s conduct or safety during a ride, they may use the in-app safety features or contact hmRide through the grievance mechanism outlined in the Grievance Redressal section.
ELIGIBILITY
You must be at least 18 years of age and legally competent to enter into a valid and binding contract under applicable law in order to access or use the Platform. By using the Platform, you represent and warrant that you satisfy these eligibility requirements.
Access to and use of the Platform is further subject to the successful completion of mandatory verification procedures as prescribed by hmRide from time to time. The Company reserves the right to restrict, suspend, or deny access to any user who fails to meet such eligibility or verification requirements.
ACCOUNT REGISTRATION & VERIFICATION
All users are required to create an account on the Platform and complete the prescribed identity verification process prior to accessing or using any services.
Registration on the Platform is subject to the submission of accurate and complete information, and continued access is conditional upon successful verification.
The verification process may include, without limitation, government-issued identity verification (including Aadhaar-based authentication, where permitted by applicable law), live photo or liveness verification, and such additional checks as may be required by hmRide from time to time. By registering on the Platform, you consent to the undertaking of such verification procedures.
You agree to provide information that is true, accurate, complete, and kept up to date at all times. hmRide reserves the right to suspend, restrict, or reject any account, at its sole discretion, in the event of incomplete, inaccurate, false, or suspicious information, or failure to comply with the verification requirements.
SERVICE STRUCTURE & RIDE MODES
hmRide offers different types of ride options (“Modes”) designed to provide flexibility, safety, and comfort to users. Each mode has specific eligibility and usage conditions as explained below:
- Blue Mode (Standard Carpooling): This is the default ride option available to all verified users of the Platform. It allows shared rides between individuals, including mixed-gender participation, subject to successful verification.
- Pink Mode (Female-Only Carpooling): This mode is exclusively designed for female users. Only verified female car owners and female passengers can access this feature. For safety and privacy, this mode is not visible or accessible to male users on the Platform. Access is granted strictly based on gender verification through submitted identity credentials.
- Pink-Bike (Female Two-Wheeler Service): This is a short-distance ride option (typically between 3 to 10 kilometres) operated exclusively by verified female car owners for female passengers. This mode includes mandatory safety requirements such as the use of dual helmets and proper safety fittings (including saree guards or similar protective measures), which must be complied with at all times during the ride.
- Green Mode (Family-Friendly Rides): This mode is designed for higher-trust travel needs, such as rides involving senior citizens or minors. Car owners operating under this mode undergo enhanced verification and screening before being permitted to offer such rides.
hmRide reserves the right to modify, restrict, suspend, or allocate access to any of the above modes at its sole discretion, in the interest of safety, compliance, or operational requirements.
With respect to rides involving minors (persons under 18 years of age), including under Green Mode, the following conditions shall apply:
- A minor shall only be permitted to travel as a passenger on the Platform with the prior express consent of their parent or legal guardian.
- By booking or facilitating a ride for a minor, the parent, guardian, or accompanying adult represents and warrants that they have provided such consent, are aware of the terms of the ride, and accept full responsibility for the safety and wellbeing of the minor during the journey.
- hmRide does not independently verify or confirm the presence or consent of a parent or guardian and shall bear no liability for any incident, accident, or harm involving a minor passenger arising from the absence of such oversight.
- In accordance with the Digital Personal Data Protection Act, 2023, personal data of a minor may only be processed with verifiable parental consent. By registering a minor on or through the Platform, the parent or guardian provides such consent on behalf of the minor and takes responsibility for the accuracy of information submitted.
hmRide reserves the right to require additional documentation or verification before permitting a minor to be registered or to travel on the Platform.
HOW THE PLATFORM WORKS
The Platform uses automated, algorithm-based systems to match users with available rides based on factors such as location, preferences, and availability. These matches are generated dynamically and may vary from time to time.
While hmRide endeavours to provide efficient and reliable matching services, it does not guarantee the availability of rides at all times, the exact timing of matches, or the accuracy of fare estimates displayed on the Platform. All such estimates are indicative in nature and may vary depending on real-time conditions.
USER OBLIGATIONS
By using the Platform, you agree to use it in a lawful and responsible manner at all times. You shall maintain respectful and appropriate conduct while interacting with other users and shall not engage in any form of harassment, discrimination, or unsafe behaviour.
You further agree not to misuse any gender-restricted services, including but not limited to accessing or attempting to access such services through false or misleading information. You are also responsible for providing accurate ride details, including pickup location, destination, and any other relevant information, to ensure smooth functioning of the Platform.
FARES, PAYMENTS & WALLET
Ride fares on the Platform are determined based on factors such as distance, route, and system-generated pricing parameters, and are subject to applicable caps as defined by hmRide from time to time.
Payments for rides may be made through integrated digital payment systems available on the Platform or through the in-app wallet, where applicable. By using the Platform, you expressly authorize hmRide to deduct applicable charges, adjust wallet balances, and process any automated deductions in accordance with these Terms.
PUNCTUALITY & AUTOMATED PENALTY MECHANISM
hmRide enforces a strict punctuality framework to ensure timely and efficient ride experiences for all users.
A penalty shall be triggered where a user (whether car owner or passenger) is delayed by 10 minutes or more beyond the scheduled pickup time.
The penalty shall apply only if the other party is confirmed to be present within a 200-metre radius of the designated pickup location, as determined by the Platform.
In such cases, a sum of Rs. 50 shall be automatically deducted from the delayed user’s wallet and credited to the punctual user, without any requirement of manual intervention.
The entire process of determining delay, proximity, and penalty imposition is fully automated and based on system-generated GPS data and time records.
All such system-generated records and logs shall be considered final and binding for the purpose of penalty determination and enforcement.
CANCELLATIONS
Users may cancel a booked ride at any time prior to the commencement of the journey, subject to the following conditions:
- Cancellations made before a car owner has accepted the ride request will not attract any cancellation fee or penalty.
- Cancellations made after a car owner has accepted the ride request but before the car owner reaches the pickup location may attract a cancellation fee, the amount of which shall be notified on the Platform at the time of booking or cancellation.
- Cancellations made after the car owner has arrived at or is in close proximity to the designated pickup location (as determined by the Platform’s GPS system) shall be subject to a higher cancellation fee, as displayed on the Platform.
- Car owners who cancel an accepted ride request without a valid and documented reason may be subject to penalties, a reduction in their Punctuality Score, or reduced matching priority on the Platform.
- Users who engage in repeated or habitual cancellations — whether as car owners or passengers — may be subject to the following consequences at hmRide’s discretion: temporary restrictions on booking or offering rides; reduced visibility and matching priority on the Platform; and in cases of persistent or bad-faith cancellations, suspension or restriction of the user’s account.
The specific fee amounts and thresholds applicable to cancellations shall be determined and updated by hmRide from time to time and shall be prominently displayed on the Platform at the time of booking. Such fee schedule shall form an integral part of these Terms upon publication.
SAFETY & MONITORING
All rides on the Platform are subject to real-time GPS tracking for safety and operational purposes. Any deviation from the planned or expected route may automatically trigger alerts to the passenger.
Such deviations may also result in notifications being sent to hmRide’s safety systems for monitoring and review.
hmRide reserves the right to intervene, take appropriate action, or initiate safety measures in cases of suspected risk, irregular activity, or safety concerns.
RATINGS & PERFORMANCE METRICS
Users on the Platform are subject to a Punctuality Score and other performance metrics, which are determined based on their conduct, timeliness, and overall usage of the Platform.
These metrics may directly impact the user’s ride matching priority, including how frequently and quickly they are matched with other users.
The metrics may also affect the user’s visibility on the Platform, including their prominence in search and matching results.
Additionally, access to certain features, benefits, or modes on the Platform may be restricted or enabled based on such performance metrics.
PROHIBITED ACTIVITIES
Users shall not engage in any form of fraud, impersonation, or misrepresentation, including providing false information or misusing another person’s identity.
Users shall not circumvent the Platform, including by entering into direct or offline arrangements with other users to avoid platform processes, payments, or safeguards.
Users shall not misuse any restricted or category-specific modes, including but not limited to attempting to access gender-restricted services such as Pink Mode through false or misleading information.
Users shall not engage in any abusive, unlawful, unsafe, or inappropriate conduct, including harassment, threatening behaviour, or any activity that may compromise the safety, dignity, or rights of other users.
SUSPENSION, TERMINATION & BLACKLISTING
hmRide reserves the right to suspend, restrict, or terminate any user account in the event of a breach of these Terms.
Such action may also be taken in cases involving misconduct, safety concerns, or behaviour that may pose a risk to other users or the Platform.
Accounts may further be restricted or terminated for non-compliance with platform rules, policies, or verification requirements.
In serious or repeated cases, hmRide may impose permanent restrictions on re-registration, subject to applicable laws and internal review processes.

PRIVACY
hmRide collects, stores, and processes personal data, including but not limited to identity documents, Aadhaar-based authentication data (where applicable), live photographs, GPS location data, device information, and usage-related data, strictly in accordance with its Privacy Policy and applicable law, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”).
Such personal data is collected and used for the following purposes: user onboarding and identity verification; ride matching and facilitation; safety monitoring and GPS tracking; customer support and grievance resolution; compliance with applicable laws and regulations; and improvement of Platform services.
By accessing or using the Platform, you expressly consent to the collection, use, storage, and processing of your personal data as described in this section and in the Privacy Policy.
In accordance with the DPDP Act, users (as “Data Principals”) have the following rights with respect to their personal data processed by hmRide:
- The right to access a summary of the personal data held about them and information about how it is being processed.
- The right to request correction of personal data that is inaccurate, incomplete, or outdated.
- The right to request erasure of personal data where it is no longer necessary for the purpose for which it was collected, subject to any legal retention obligations.
- The right to raise grievances in relation to the processing of personal data, through the Grievance Officer as specified in the Grievance Redressal section.
- The right to nominate another individual to exercise the above rights on their behalf in the event of the user’s death or incapacity.
Consent given by a user for the processing of their personal data may be withdrawn at any time by contacting the Grievance Officer. However, withdrawal of consent may result in partial or complete inability to access services on the Platform.
hmRide shall retain personal data only for as long as reasonably necessary to fulfil the purposes for which it was collected, or as required under applicable law. Upon expiry of the applicable retention period, personal data shall be deleted or anonymised in accordance with hmRide’s data retention policy.
For detailed information on how your data is collected, used, stored, shared, and protected, please refer to hmRide’s Privacy Policy available on the Platform, which forms an integral part of these Terms.
DISCLAIMER OF WARRANTIES
The Platform is provided on an “as is” and “as available” basis, without any representations or warranties of any kind, whether express or implied.
hmRide does not warrant that the Platform will be uninterrupted, error-free, secure, or free from delays, defects, or technical issues.
hmRide makes no representations or warranties regarding the availability, accuracy, reliability, or completeness of any information, content, or services provided through the Platform.
hmRide does not guarantee the availability of rides, suitability of car owners, or compatibility between users, as all services are facilitated through independent third parties.
To the fullest extent permitted under applicable law, hmRide disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
INSURANCE, ACCIDENTS & LIMITATION OF COVERAGE
hmRide does not provide, arrange, or facilitate any form of insurance coverage — whether personal accident insurance, health or medical insurance, third-party liability coverage, or any other form of insurance — for users, car owners, passengers, or any other party in connection with rides facilitated through the Platform. This applies to all ride modes offered on the Platform, including Blue Mode, Pink Mode, Pink-Bike, and Green Mode.
Users acknowledge and expressly agree that:
- It is the sole legal responsibility of every car owner operating on the Platform to ensure their vehicle is covered by a valid and adequate motor insurance policy, including third-party liability coverage, in strict compliance with the Motor Vehicles Act, 1988 and any applicable regulations thereunder.
- hmRide does not verify, guarantee, or take responsibility for the existence, validity, scope, or adequacy of any motor or personal insurance held by any car owner registered on the Platform.
- In the event of any road accident, personal injury, illness, death, or damage occurring during or in connection with a ride facilitated through the Platform, users shall have no right to seek compensation, indemnification, or damages from hmRide in connection with such events.
- All claims arising from accidents or incidents during a ride shall be the exclusive responsibility of the concerned car owner, their insurer, and/or the relevant governmental or regulatory authority, as applicable.
- Users are strongly encouraged to obtain their own personal accident insurance or travel insurance prior to using the Platform. hmRide makes no recommendation regarding any specific insurance provider or product.
- Items of personal property, luggage, or belongings carried during any ride are done so entirely at the user’s own risk. hmRide accepts no liability for loss, theft, or damage to any such belongings, regardless of the circumstances.
Nothing in this section limits hmRide’s liability where such limitation is prohibited under applicable Indian law.
INDEMNITY
You agree to indemnify, defend, and hold harmless hmRide, its directors, officers, employees, and affiliates from and against any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform.
This includes, without limitation, any claims arising from your misuse of the Platform, including unlawful or unauthorized activities conducted through your account.
You shall also be liable for any consequences arising from your breach of these Terms or any policies incorporated herein.
Further, you agree to indemnify hmRide against any claims arising due to your violation of applicable laws, regulations, or third-party rights.
GRIEVANCE REDRESSAL
In compliance with applicable laws, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, users may raise grievances relating to the Platform or any content thereon by contacting hmRide’s designated Grievance Officer:

hmRide shall acknowledge all grievances within 24 (twenty-four) hours of receipt and shall make best efforts to resolve them within 15 (fifteen) days from the date of receipt, unless a longer period is required due to the nature of the complaint.
Grievances that involve safety concerns, harassment, or reports of ride-related misconduct shall be treated as priority matters and addressed on an expedited basis.
GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes, claims, or differences arising out of or in connection with these Terms or the use of the Platform shall be referred to and resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
The seat and venue of arbitration shall be New Delhi, and the proceedings shall be conducted in the English language.
MODIFICATION OF TERMS
hmRide reserves the right to modify, amend, or update these Terms at any time, at its sole discretion, to reflect changes in services, legal requirements, or business practices.
Any such modifications shall be effective upon being published on the Platform, unless otherwise specified.
Users are encouraged to periodically review these Terms to stay informed of any updates.
Your continued access to or use of the Platform after such changes constitutes your acceptance of the revised Terms.
FORCE MAJEURE
hmRide shall not be held responsible or liable for any failure, delay, interruption, or degradation in the provision of services through the Platform where such failure arises out of or is caused by circumstances beyond hmRide’s reasonable control. Such circumstances include, without limitation:
- Acts of God, natural disasters, floods, earthquakes, storms, or other extreme weather events;
- Epidemics, pandemics, or public health emergencies declared by competent authorities;
- Civil unrest, riots, war, strikes, or lockdowns;
- Actions, orders, or directives of any governmental, judicial, or regulatory authority, including changes in applicable law or regulations;
- Failures or disruptions in internet connectivity, telecommunications networks, power supply, or third-party infrastructure;
- Cyberattacks, malware, data breaches, or other malicious acts directed at the Platform or its infrastructure;
- Any other event that is outside hmRide’s reasonable control and that materially prevents or significantly delays the provision of services.
In the event of a force majeure, hmRide’s obligations under these Terms shall be suspended for the duration of such event, without any liability to users for any resulting inconvenience, loss, or damage. hmRide shall make reasonable efforts to communicate the impact of such an event to users and to resume normal operations as soon as practicable.
INTELLECTUAL PROPERTY
All intellectual property on or associated with the Platform, including the hmRide name and logo, the application design and user interface, the ride-matching algorithm and underlying technology, all content, graphics, text, and data published on the Platform, and all trademarks, service marks, and trade names, are the exclusive property of M/s Humride Mobility Private Limited or its licensors, and are protected under applicable Indian and international intellectual property laws.
Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to:
- Copy, reproduce, redistribute, or create derivative works based on any content or technology from the Platform;
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Platform or any component thereof;
- Use hmRide’s trademarks, logos, brand name, or any similar marks in any manner without prior written authorization from hmRide;
- Scrape, crawl, harvest, or systematically extract data from the Platform using automated tools, bots, or scripts;
- Frame, mirror, or reproduce any portion of the Platform on another website or digital platform without express consent.
Any unauthorized use of hmRide’s intellectual property shall constitute a material breach of these Terms and may result in suspension or termination of the user’s account, in addition to civil and criminal remedies available under applicable law.
MISCELLANEOUS
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms constitute the entire agreement between you and hmRide with respect to the use of the Platform and supersede all prior understandings or agreements, whether written or oral.
Any failure or delay by hmRide in enforcing any provision of these Terms shall not be construed as a waiver of its rights to enforce such provision or any other provision at any time thereafter.
